Probation - We Do More Than You Think....

Probation officers wear a multitude of hats during the course of their workday. They are observers, listeners, investigators, analysts, advisors, motivators, educators, facilitators, problem solvers, crime prevention specialists, and victim services coordinators. The officers see the offenders in their offices, in their homes, in the schools and workplaces, in treatment, in custody, and in the community. Each officer brings their own kind of special gift to the work of supervising offenders. Probation officers are dedicated, hard-working individuals who are truly concerned about making a difference in our communities.

Criminal Court Probation is the primary criminal sanction for the largest number of convicted offenders in the United States.

Family Court Probation addresses juvenile crime and intervenes with youth and families at risk.

Probation Department Briefing

All Ontario County Probation Department Administrative Office and Criminal and Family Court services are based in Canandaigua, New York (USA). Services are also located in Geneva, New York several days per week

State Mandate

The mandates for the Department's duties derive from New York State Law. Section 256, paragraph 1 of the New York State Executive Law that provides for the establishment of county probation agencies. "Each county shall maintain or provide for a probation agency or agencies to perform probation services therein, including intake, investigations, pre-sentence reports, supervision, conciliation, social treatment, and other such functions as are assigned to probation agencies pursuant to law." Subsequently, the department is a county agency operating under the mandates of the New York State Division of Probation and Correctional Alternatives. Although the State contributes to the cost of Probation, two thirds of the department's annual budget of approximately 2.25 million dollars is from local tax dollars. With a staff of 39 including 33 sworn peace officers: 1 Director, 4 Probation Supervisors, 7 Sr. Probation Officers and 21 Probation Officers, the department is the 20th largest of 59 county departments and is considered a medium size department. 2008 will mark the 95th anniversary of the Ontario County Probation Deaprtment.

Who Do We Serve

The department provides probation services to all of the courts within the County served by the 7th Judicial District. Within Ontario County, this represents the New York State Surrogates Court, Family Court, Supreme Court, the Ontario County Court (felony cases), and city, town and village courts (misdemeanors and violations). Additional services are provided to victims of crime, Persons In Need of Supervision (PINS), and individuals who are in pre-trial status, as well as Community Service Sentencing.

Service Delivery Provided

The department is divided into four sections: the Adult Supervision, ATI, Investigation, and Juvenile Units.

The department's annual workload reflects its wide-range of program initiatives, such as:

  • Probation officers assigned Criminal Court Services supervise approximately 1000 probationers and complete over 1100 Pre-Sentence Investigations annually.
  • Restitution payments are collected that are automatically disbursed to victims as determined by the Courts.
  • Over $50,000 in fees are collected annually in Administrative Fees from probationers convicted of DWI offenses and surcharge for restitution.
  • Group sessions for sex offenders, (SOTP Group) are conducted weekly, including the use of polygraph testing.
  • Commitment To Change, formerly the Criminal Thinking Group
  • Victim Impact Panels for DWI offenders are conducted quarterly in partnership with the District Attorney's office.
  • Day Reporting Program
  • Operation Night Watch
  • Project Safe Neighborhoods

The department's functions vary widely; however, its primary services include the following:

  • Conducting Family Court intakes to determine if a case can be resolved without filing a Family Court Petition for Juvenile Delinquency or Persons In Need of Supervision (PINS) cases.
  • Conducting pre-plea or pre-sentence investigations for Criminal Court defendants and pre-disposition investigations for Family Court.
  • Providing interim supervision, including electronic monitoring and Pre-Trial Release.
  • Supervising juveniles and adults who receive a probation term.
  • Collecting restitution and other fees from probationers and non-probationers as ordered by the Court.
  • Felony Diversion.

Providing services to crime victims

Since the department does not use a generalist model of service delivery, the following represents the organizational breakdown of specialist functions:

  • Treatment Accountability for Safer Community (TASC) including Felony Diversion, DWI, and High Risk Offenders from Drug Court.
